Telephone Lawful Use and Trigger Data Accuracy
Each day we pass the Trigger Lead phone numbers against the Federal Do-Not-Call Database. Any records with phone numbers on the Federal DNC Database are removed from the available leads. Doing so protects you from calling someone on the file. Please note that the phone numbers provided are those captured from the Equifax, Trans Union, and Experian Credit Bureaus.
We offer a very specific guarantee on our phone numbers. Disconnected numbers are to be expected. Telemarketers should expect a degree of disconnects in the range of 5% to as high as 15%. Disconnected numbers above 15% of the initial order will be replaced. It should be noted that this applies only to disconnected numbers and NOT fax numbers, wrong numbers, privacy blocked numbers, or any other condition not considered in our sole discretion to be disconnected. Clients must provide a list of complete records in the format in which they were originally conveyed to the client with (15) business days of the completion of our contract service of lead delivery.
No Warranty, Liability
The Lists are provided to client “AS IS”. TriggerLeaders.com MAKES NO WARRANTIES AND EXPRESSLY DISCLAIMS ALL IMPLIED REPRESENTATIONS AND WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE LISTS. In no event shall TriggerLeaders.com or any primary & secondary party processor be liable for direct, indirect, incidental, consequential or punitive damages, including lost profits, even if advised of the possibility thereof. In the event of termination client shall: (i) discontinue using the applicable Lists; (ii) remove from its files, computers and systems all copies of the Lists and (iii) return to TriggerLeaders.com the Lists and any materials or other documents evidencing the Lists; and/or destroy all copies of the Lists as requested.
Firm Offer of Credit Requirement
FTC requires that all data extracted from credit bureaus for marketing purposes be used only for a Firm Offer of Credit. This means that you are making an offer of the following, “you have been pre-selected for a mortgage loan”. You must agree to and state, when asked, the terms of the firm offer of credit. You will receive the terms of this firm offer as well as Opt-Out information required by the FTC that you must read, sign and fax back to TriggerLeaders.com in order to receive final approval.
Offers made by mail are also subject to a firm offer of credit and disclosure requirements as mandated by federal law. Data Output
Certain Federal Trade Commission directives require that we deliver only name, address, and telephone numbers on certain third party credit data orders. In all cases we will provide only that data attributes deemed to be in accordance to all know Federal, State and local laws. Those you may select within fields such as Credit Score and/or Mortgage Balance, the individual records will not contain any associated information.
